Francis J. O’Brien Society
The Francis J. O’Brien Society honors individuals who have made a charitable planned gift (such as bequests, appreciated securities, gifts of retirement accounts, or life insurance) or have made it known their intentions to include Albany College of Pharmacy and Health Sciences in their wills or estate plans. Membership in this society expresses your belief in ACPHS and demonstrates your commitment to improving the future through higher education. Your generosity not only works as a catalyst for positive change, but also inspires others to get involved and make a difference.
This giving society is named in honor of Francis J. O’Brien, an alumnus of the Class of 1920 and former Professor and Dean at the College. Dean O’Brien is often credited with transforming the College and Pharmacy as a profession during his tenure. Dean O’Brien left a lasting impression on his students and the College as a whole.

The following language may aid you and your attorney in preparing your bequest to the Albany College of Pharmacy and Health Sciences. Each individual situation is unique and, therefore, these examples include only some of the possible gift opportunities. We encourage you to share your final will provision with ACPHS to ensure that your wishes can be properly followed and recognized.
NAME , I give, devise and bequeath (specific asset; dollar amount; % of estate; etc.) to the Albany College of Pharmacy and Health Sciences , a nonprofit corporation organized in accordance with the laws of the State of New York for the purpose of supporting the Albany College of Pharmacy and Health Sciences, an educational institution, located at Albany, New York. The property comprising this gift may be merged, for investment purposes, with any of the general investment assets of the Albany College of Pharmacy and Health Sciences. The distributions from the gift shall be:
a) unrestricted, unless directed by a separate gift agreement.; or
b) used to ... (after consulting with the Foundation, include specific gift-use preference(s) here, and include the following sentence to ensure your gift remains useful in the future.)The gift shall be entered in the Foundation’s books and records as the (desired name of fund) Fund, and shall always be so designated. If, in the judgment of the Foundation Board of Trustees, changed circumstances should, at some future time, render the designated use of this fund impracticable, unwise or inappropriate, then the Board shall use the fund to further the objectives and purposes of the Albany College of Pharmacy and Health Sciences, giving consideration to my special interest as evidenced by the purpose described above.

There are two ways to receive payments with charitable remainder trusts:
The annuity trust pays you, each year, the same dollar amount you choose at the start. Your payments stay the same, regardless of fluctuations in trust investments.
The unitrust pays you, each year, a variable amount based on a fixed percentage of the fair market value of the trust assets. The amount of your payments is redetermined annually. If the value of the trust increases, so do your payments. If the value decreases, however, so will your payments.

There are two ways charitable lead trusts make payments:
A charitable lead annuity trust pays a fixed amount each year to ACPHS and is more attractive when interest rates are low.
A charitable lead unitrust pays a variable amount each year based on the value of the assets in the trust. With a unitrust, if the trust’s assets go up in value, the payments to ACPHS will increase as well.

Your gift helps us continue our work for years to come. And a gift of real estate also helps you. When you give us appreciated property you have held longer than one year, you qualify for a federal income tax charitable deduction. You avoid paying capital gains tax. And you no longer have to deal with that property’s maintenance costs, property taxes, or insurance.
Another benefit: You don’t have to hassle with selling the real estate. You can deed the property directly to ACPHS or ask your attorney to add a few sentences in your will or trust agreement.
There are many mechanisms to donate real estate including an outright gift, via your will or living trust, through a retained life estate, a bargain sale, or within a trust or annuity.
